Prenuptial Agreements

Pre Nuptial Agreements in EdinburghAs a network of family law firms one of the services we offer is prenuptial agreements more commonly known as prenups. Prenuptial agreements can be used both by couples marrying and couples entering into a civil partnership.

Prenuptial agreements – what are they?

Prenuptial agreements are the sort of agreement written up to protect both parties entering into a marriage or civil partnership. They are there to help regulate the division of assets if in the future the marriage or civil partnership does not last and a divorce or dissolution happens. As an experienced network of family law firms, we appreciate how any prenuptial agreement can feel uncomfortable, even to raise the question of such an agreement when you are about to get married or about to enter into a civil partnership. We are experienced enough to know that a prenup really can give peace of mind to both parties involved and can save a lot of heartaches further down the line.

The most common circumstances where a prenuptial agreement may help is when one partner is much wealthier than the other or for couples getting married for a second time where they have accumulated assets which they feel need protected for let’s say children that they have had in a previous relationship or any other next of kin, family or friends.

You may be about to embark on marriage, civil partnership or a cohabiting relationship, but wish to protect a business or personal assets. We have a team of experienced lawyers waiting to give any advice on prenuptial agreements and post-nuptial agreements, as well as cohabitation agreements.  We can also advise at this time on other methods of protecting your assets, such as putting them into trust, or simply preparing or changing an appropriate will.

Prenuptial agreements – what is the first step?

The first step would be to arrange an appointment to come in and go over what your circumstances are and for advice on prenuptial agreements and post-nuptial agreements, as well as cohabitation agreements.  We can offer advice on Trust Funds and other methods of protecting your wealth.  To find your local legal office, type the town / city into the search bar, your nearest legal office results will appear giving you the contact details to phone.

"I just wanted to thank you for your advice that you passed on to me with regards to my Divorce. Was very surprised that it worked as you suggested. Once again many thanks. I have kept your details and will pass them on to any family or friends that may need the services of a Lawyer in the future."

"I have really appreciated all the advice and assistance that you have given to me over the last 3 months and am very pleased with the way that you have represented my interests. Above all I have valued the way in which you have been able to communicate so well and so efficiently by explaining each stage of this negotiation by e-mail.

“Thank you very much for your assistance throughout the process – I very much appreciate your unfailingly prompt and complete assistance.”
